Under the PPH program, the NOIP can expedite the examination process for patent applications that are deemed “patentable” by making use of the KIPO’s examination results. At the same time, this program will help Korean companies acquire patents more quickly.
During the pilot implementation of the PPH Program NOIP will receive 100 PPH requests annually for patent applications originating from KIPO (i.e. previously submitted to KIPO) and meet the conditions set out in the Guidelines for Filing PPH Requests into the NOIP.
The PPH request to be submitted to NOIP must use the Form of PPH Request form prescribed by NOIP.
In contrast, KIPO will receive annually 100 PPH requests for patent applications originating from NOIP (i.e. previously filed with the NOIP) and meet the conditions specified in the Guidelines for Procedures for Filing PPH Requests into KIPO.
The PPH request to be submitted to KIPO must use the Form of PPH Request form prescribed by KIPO.
