NOTICE: Discontinuation of certain applications at the IP Vietnam

This discontinuation takes effect July 1, 2025

On June 26, 2025, the National Intellectual Property Office of Vietnam (the IP Vietnam) issued Notice No. 2351/TB-SHTT regarding the discontinuation of receiving certain administrative procedures on industrial property, effective from July 1, 2025.

The issuance of this Notice is to implement Decree No. 133/2025/ND-CP of the Government regulating decentralization and delegation in the field of state management of the Ministry of Science and Technology (the governing body of the IP Vietnam).

Below we summarize the content of the Notice and make some recommendations for applicants.

I. Main contents of the Notice:

1. From July 1, 2025, the IP Vietnam will no longer accept the following applications:

- Requests for issuance, re-issuance, revocation of Certificate of practicing industrial property representative service;

- Requests for recording,amending or deleting the name of industrial property representative agent;

- Requests for recording,amending or deleting the name of industrial property representative organization;

- Registration for industrial property representative professional examination;

- Requests for issuance, re-issuance, revocation of Industrial Property Appraiser Card;

-      Registration for industrial property appraisal examination;

- Requests for issuance of duplicate Protection Titles and re-issuance of Protection Titles/duplicate Protection Titles;

- Registration, amendment, termination or invalidation of IP licensing contracts;

- Requests for issuance of duplicates, re-issuance of Certificate of Recordal  of IP licensing contracts;

- Requests for issuing a decision to compulsorily patent licensing contracts;

- Requests for to terminate the right to use compulsorily patent licensing contracts.

2. An Organization, Individual who needs to carry out the procedures mentioned in Section 1 above shall submit the application to the Provincial People's Committee where the organization is based or where the applicant resides.

3. Applications for carrying out the procedures specified in Section 1 above, if submitted to the IP Vietnam before July 1, 2025 but not yet resolved, will continue to be processed by the IP Vietnam.

II. Our Recommendations for applicants

To ensure smooth transitionand avoid disruption of rights and business operations, applicants are advised to:

ü Review all applications submitted to the IP Vietnam before and after July 1, 2025 to take appropriate action;;

ü Contact the relevant functional department of the Provincial People's Committee where the application will be submitted as soon as possible for specific instructions on how to submit the application and pay the fee;

ü Prepare documents according to the requirements and/or forms of local authorities;

ü Consult an IP attorney or advisor for complex matters or licensing-related transactions.
