Review of NOIP's settlement of appeal requests in 2017

The Annual Report 2017 of NOIP, published in October 2018, showed that in this year 1.318 appeal requests against its decisions on refusal on granting IP protection titles were received,  of which only 730 ( 55% of the total) were considered valid and accepted for settlement by the NOIP...

The Annual Report 2017 of the National Office of Intellectual Property (NOIP) was  published in October 2018. According to this, in this year the NOIP received 1.318 appeal requests against its decisions on refusal on granting IP protection titles (including 29 appeal requests to patents, 03 to utility solutions, 19 to industrial designs and  1,.267 to trademarks), in which 730 appeal requests (accounted  for 55% of the total) were considered valid and accepted for settlement by the NOIP.

The NOIP has resolved 548 valid appeal requests (accounted  for 75% of the total), namely accepted appeal requests for protection of 136 national trademarks, 175 international trademarks; refused appeal requests for protection of 132 national trademarks and international trademarks; accepted appeal requests for protection of 04 patents and 01 industrial design; refused 37 appeal requests for cancellation and invalidation of protection titles; refused 63 appeal requests.

In terms of appeal requests for cancellation of protection titles,the NOIP has handled 43 appeal requests, namely accepted to cancel protection titles of 15 trademarks, refused to cancel protection titles of 16 trademarks; refused to cancel protection titles of 03 industrial designs; refused 63 appeal requests for cancellation of 9 protection titles

With regard to appeal requests for invalidation of trademark protection titles, 208 appeal requests were settled, in which 114 appeal requests were accepted, 94 appeal requests were refused.
