Isuzu Motors Limited, headquartered at 135 avenue Charles de Gaulle F-92200 Neuilly-Sur-Seine Cedex (FR), owner of International Registration of Mark IRN- 1293778-ISUZU (the cited mark) for protection of products in Class 12 and in other classes has petitioned with the IP Vietnam to oppose national (VN) applied-for mark applications No.4-2022-36630 “ISUZU VM” and No.4-2022-36630 “ISUZU” for protection of “"aluminum; hinge pin; mesh; metal bolts; steel in raw or semi-product form; white metal” in Class 06, “air conditioning system; air chiller; air deodorizers; microwave ovens” in Class 11 and “oilcloth; canvas; roof cover of synthetic materials; awning of textile fabrics; cables not of metal; rope ladder” in Class 22 on the grounds that the applied-for marks: (i) are confusingly similar to the cited mark already registered, widely used and recognized by Vietnamese consumers, (ii) if they are accepted for registration and use may mislead consumers as to the origin of the products bearing the marks and (iii) there is a basis to assert that those contested marks are filed with malicious intent in order to take advantage of the reputation of the well-known trademark ISUZU.
