There was no likelihood of confusion between the marks “Barona” and “Barilla”

Background

In November 2012, Nam Phuong Co., Ltd applied a Vietnamese application for registration of the mark “Barona & fig.” in the classes 29 and 30. In October, 2013, Pham & Associates, Hochiminh City Office (‘P&A’), the legal representative for Nam Phuong received an opposition against this trademark application lodged by BARILLA G. E R. FRATELLI - SOCIETÀ PER AZIONI on the basic of the earlier mark “Barilla & fig.”. In November, 2013, P&A successfully persuaded the National Office of Intellectual Property (‘NOIP’) that there was no likelihood of confusion between the marks “Barona” and “Barilla”.
