Client Update: Regulations on auctioning, purchasing, transferring the right to use domain name

On July 01, 2014, the Prime Minister issued Decision No. 38/2014/QD-TTg. New legislation that deals with auctioning, purchasing, transferring the right to use telecommunications number resources and domain name. Pham & Associates reports on the main contents.

Since 2008, the Ministry of Information and Communications has issued a Circular on management and use of internet resources, in which provided no longer prohibit sale, transfer domain name. The activities, however, met with serious difficulties as lack of the detailed guidance.

Article 35 of Decision No. 38/2014/QD-TTg prescribes procedures to transfer the right to use the domain name, e.g. required documentation, procedures for assignment of domain names through and not through auctions ect.

Transactions will not be considered as legitimate acts in case the involved parties do not pay tax of transfer according to the law, or not perform through an Accredited Registrar.
