BP’s green color mark application was rejected in Australia

As analysis in Article of “Color trademark protection in Vietnam and overseas” on June 26, 2014, the protection of color trademark in both foreign countries and Vietnam was not simple. The following the Trademark Office's decision of rejecting the trademark registration application in Australia is an interesting example.

 

In June 2014, IP Australia denied BP's application for a green color mark since the mark-applied for does not distinguish BP's goods. Although, BP amended the claim in 2012 from the original application which was filed in 2002 to select the green shade Pantone 348C as the predominant color. However, the amendment would not have any effect on the issue of whether the color mark was distinctive.
