Pham & Associates Wins a Notice of Opposition against Vietnamese Trademark Application “CALLIGARIS”

Pham & Associates, a leading local law firm, announced today that the firm is representing CALLIGARIS S.P.A. in the opposition against the Vietnamese trademark application no. 4-2011-13925 “CALLIGARIS”.

CALLIGARIS S.P.A. filed an application for the registration of the word mark CALLIGARIS (I.R. No 1005683) in Classes 11, 20, 24, 27 and 35 of the Nice Classification designated into Vietnam. The international registration was refused based on a prior Vietnamese trademark application no. 4-2011-13925.

Overcoming the refusal: On behalf of the client Pham & Associates filed an opposition to the cited trademark application together with a response against the Partial Provisional Refusal so as to keep I.R No. 1005683 alive and pending until the conclusion on the opposition is rendered.

On November 30, 2015, the National Office of Intellectual Property upheld the opposition on the sole basis that the Vietnamese trademark application No. 4-2011-13925 “CALLIGARIS” in the name of Phan Quang Hieu was identical to the CALLIGARIS S.P.A.’s mark which was being wide used prior to its filing date.
